Nissei ASB concludes US patent litigation against R&D Tooling

Nissei ASB Machine Co., Ltd. (Head Office: Komoro-shi, Nagano-ken, Japan; President: Junichi Miyasaka) filed a lawsuit against R&D Tool & Engineering Co., Ltd. (“R&D”, Head Office: Missouri USA) alleging the infringement of ASB’s patents in the United States District Court for the Northern District of Georgia on February 1, 2018. The lawsuit was transferred to the United States District Court for the Eastern District of Missouri on January 18, 2019. Nissei ASB Machine Co., Ltd. (“ASB”) has now reached a settlement with R&D.

ASB alleged that R&D’s mold of the ASB-150DPW (“150DPW”), ASB’s one-step injection stretch blow molding machine, infringed upon ASB’s US Patent Nos. 8,608,466, 8,998,602, and 8,613,614.

Under this settlement, ASB will receive an undisclosed amount from R&D for the past sales of R&D’s mold of the 150 DPW.

ASB will grant R&D a limited, non-exclusive, royalty-bearing license to sell its molds for the 150DPW.

The patents-in-suit remain fully valid and enforceable.

The details of the settlement terms are subject to confidentiality.

ASB will continue to take appropriate measures against any entities anywhere in the world to provide suitable protection of ASB’s patents and other intellectual property rights.
